Financial planning for divorce is smart. The reality is that a staggering proportion of first time marriages fail; approaching 50%. Thankfully there are several things we can do to prepare for this regrettable outcome: ensure retirement accounts are equally funded for both partners, title assets jointly, keeping career skills current, and being aware of your financial picture are great places to start.
The prenup’ was once the exclusive domain of the rich and famous but is increasingly being adopted by middle-income couples as a financial planing tool. If either partner is bringing sizeable assets to the union then it may be prudent to execute a prenuptial legal agreement to ensure an orderly decoupling of financial assets, as unromantic as that sounds. Pre-nups automatically set you up for failure. You know you have a safe-haven to run to if things get too tough. Marriage is forever, and unless there is unfaithfulness there is no reason to divorce. Why not prepare for marriage and work at your marriage instead of creating adequate funds “just in case you become part of the 50%”? All of this is giving you an escape route when marriage is “until death do us part”….if you allow Christ to be the center of the relationship it will thrive and the word “divorce” will never be brought up.
Excellent argument Jon. I agree, they can be a door to an exit without trying hard enough to work through the issues that we deal with in marriage. Prenups do lose value over time, I believe after 10 years of marriage they are effectively void.
I would be interested to hear what others have to say about reasons for divorce. What about an abusive partner, emotional or physical? What about chronic substance abuse? What about abandonment?
By unfaithfulness, do you mean infidelity or no longer Christian?

I would say the prenup is similar to life insurance. You would hate to use it but just in case “life” happens it’s best to be prepared.

I think it’s a good idea, but a touchy one to bring up with your potential spouse.
I think to be successful with such a proposal, you’d have to bring it up while dating, and let it slowly seep in.
Mostly it is for couples that have 1 spouse making much, much more money than the other one. Kim Kardashian is a great example.

I agree, it is a very touchy subject. The Kardashian example is a good one, and I wonder how the courts will decide on this 72 day marriage?
Another example that comes to mind is the Cruise Kidman divorce. He filed for divorce on the eve of their 10th wedding anniversay. Tom brought significantly more assets and earning power to the marriage but the courts threw out the prenup and split the combined net worth equally between the two of them.
They’re not water-tight agreements and thankfully the courts can see common sense. I think they may sometimes be appropriate for financial planning, along with other tools.

Thanks for the link-love. I think financial planning for divorce is smart, when it comes to having an idea and some plans in place in the ‘what-if’ case, but personally I would never go for a pre-nup.
You’re absolutely correct Andrea. It is a deeply personal decision to go with a prenup and I don’t think I could go through with it either. I like to think that I am marrying my equal. Lawyers and courts can happily stay out of my personal life.
Great post. No prenup here, but I think it actually does make getting a divorce easier. From a business standpoint, it does make sense. Maybe we’re lucky we’re not millionaires yet? We have a better chance for a long and happy marriage. I enjoyed Kevin’s video, too. Pretty good singing, he’s being himself, and it’s unique. Thanks for sharing!

I think it’s terrible when marriages fall apart. Not only does the couple divide their assets, they generally divide their friends too.
